TRUE TEMPER BASEBALL BAT LIMITED WARRANTY AND LIMITATION OF LIABILITY

IMPORTANT: BY PURCHASING A TRUE TEMPER (OF 40 SOUTH MAIN STREET, FLOOR 20, MEMPHIS, TN 38103, (“TRUE TEMPER”)) BASEBALL BAT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE TRUE TEMPER ONE (1) YEAR LIMITED WARRANTY AS SET OUT BELOW.

IF YOU DO NOT AGREE TO THE TERMS OF THE LIMITED WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT TO TRUE TEMPER SPORTS WITHIN 30 DAYS OF PURCHASE FOR A FULL REFUND.

 

ELIGIBLE TRUE BATS

For a period of one year from the date of original purchase, True Temper will provide a limited warranty for the following bats against defects in materials or workmanship:

Hybrid Baseball Bats

Aluminum Baseball Bats

1 YEAR LIMITED WARRANTY

Under this limited warranty, TRUE Temper will provide a one-time repair or replacement of your bat within one (1) year from the date of purchase for the following defects in materials or workmanship resulting from normal field use:

  1. Severe denting;
  2. Structural cracking; and/or
  3. Broken end caps or knobs

What is NOT Covered

This Limited Warranty does not cover: (a) cosmetic damages, including but not limited to scratches or non-severe dents; (b) damages caused by the user’s negligence, accident, mistreatment, abuse, misuse, fire, liquid contact, or any other external cause; (c) damages relating to alterations; (d) bats used in temperatures under 60° F (15° C); (e) bats purchased from non-authorized True Temper dealers or persons; (f) bats that have been used with weighted training balls; (g) bats that have been transferred from the original purchaser; (h) bats used as team bats by multiple players; (i) bats used as commercial bats (for example, “loaner” bats at commercial batting cages), (j) demo bats; (k) damages caused by service performed by anyone who is not a representative of True Temper; (l) a True Temper bat that has been modified to alter functionality or capability; (m) damages/defects caused by normal wear and tear or otherwise due to the normal aging of the True Temper bat (all materials are subject to fatigue and breakdown over time); (n) damages or claims related to the stated weight of the bat, indicated by the drop, which is not intended to, and should not be relied upon to, calculate the actual weight of the bat; (o) variances in the actual weight of the bat versus the labeled approximate weight of the bat as the actual bat weight may vary for numerous reasons, including without limitation manufacturing tolerances, certification calculations and standards, the grip weight, the length of the bat, performance considerations, modifications/additions made after purchase, and/or other reasons; or (p) any product for which  you cannot present proof of purchase.

True Temper does not approve of or authorize the purchaser to physically alter their bat.  Alterations include but are not limited to: rolling a bat in a vice, hitting foreign objects other than proper balls, inner wall shaving, end-loading the bat, or any other “bat doctoring” that is designed to change the character of performance of the bat in any way. Any suspected alteration of the bat will nullify this Limited Warranty.

This limited warranty can only be redeemed by the original purchaser. This limited warranty is also limited to one replacement bat per original purchaser.

SUBMITTING A LIMITED WARRANTY CLAIM (US. AND CANADA)

Please follow the steps below to process your limited warranty claim:

  1. DO NOT RETURN YOUR BAT TO A RETAILER OR A TRUE FITTING REPRESENTATIVE.
  2. Complete the Warranty Claim for Baseball Bats
  3. The limited warranty submission must include the ORIGINAL RECEIPT (proof of purchase) and a photo of the defective section.  Proof of purchase is required to be eligible for limited warranty coverage.

**If True Temper determines a replacement bat is appropriate, True Temper will only provide replacement bats:

  • of equal or greater value;
  • the same approximate weight/drop;
  • for use within the same sport (i.e., returned baseball bats that are approved for replacement will be replaced with a baseball bat); and
  • for the same certification type/standard as the returned bat (e.g.., returned USSSA that are accepted for warranty return will be replaced with a USSSA-approved bat)
  1. If True Temper deems that the bat is ineligible for this limited warranty coverage, a written explanation will be provided.

NOTE: Limited Warranty coverage will be determined exclusively by True Temper.  True Temper cannot guarantee limited warranty coverage of your product until it is inspected and determined to be limited warranty eligible. Once the physical bat or image is received, if True Temper determines that the product is eligible for limited warranty coverage, a repaired or replacement product will be shipped via Ground Delivery within three business days after receipt of the returned bat.  True Temper reserves the right to substitute similar product.  The decision to replace a defective bat with a repaired or replacement bat, including a substitute model, is within the sole discretion of True Temper. TRUE Temper reserves the right to refuse limited warranty service to any person who our Warranty Department deems as abusing our products or our limited warranty policy.

LIMITATION ON STATUTORY OR IMPLIED WARRANTIES OR CONDITIONS

TO THE FULL EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TRUE TEMPER LIMITS ALL STATUTORY AND IMPLIED WARRANTIES AND CONDITIONS, INCLUDING WITHOUT LIMITATION, WARRANTIES/CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES/CONDITIONS AGAINST HIDDEN OR LATENT DEFECTS, TO A PERIOD OF ONE (1) YEAR FROM THE DATE OF THE ORIGINAL PURCHASE OF THE PRODUCT AND TO THE REMEDIES OF REPAIR OR REPLACEMENT IN THIS WARRANTY.   Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State (OR province to province or COUNTRY TO COUNTRY).

LIMITATION OF LIABILITY


EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUE TEMPER IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF THE LIMITED WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF INCOME/TIME; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOOD WILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION THE REPLACEMENT OF EQUIPMENT AND PROPERTY.

SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY  TO YOU.

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE (OR PROVINCE TO PROVINCE).

THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY FOR THIS PRODUCT AND EXCLUDES ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. 

ANY LIABILITY OF TRUE TEMPER IS LIMITED TO THE REMEDIES OF REPAIR OR REPLACEMENT AS SET OUT IN THIS WARRANTY.

DISPUTES SUBJECT TO ARBITRATION ONLY

To the extent permitted by law in the jurisdiction of your purchase, by purchasing this product, you agree that any controversy, claim or dispute arising out of or relating to this product or this Limited Warranty shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.  The arbitrator shall have experience with product litigation or arbitration.  All arbitration fees and costs of the AAA shall be shared equally by the parties.  The arbitration will be held in a location agreed to by the parties or, if no agreement, in a place determined pursuant to the AAA rules.  The non-prevailing party shall pay the reasonable attorneys’ fees and costs of the prevailing party. This  agreement to arbitrate disputes includes, but is not limited to, all claims arising out of or relating to any aspect this product, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory whatsoever, and regardless of when or where the claims arise. YOU UNDERSTAND AND AGREE THAT, BY PURCHASING THIS PRODUCT YOUR ARE ENTERING INTO THESE TERMS, AND YOU AND TRUE TEMPER ARE EACH WAIVING THE RIGHT TO A TRIAL BY JUDGE OR JURY OR TO PARTICIPATE IN A CLASS ACTION.

 

120 Day Fit Guarantee

 

At TRUE Temper, our main goal is to get the right bat into the hands of our athletes.

TRUE Temper offers a 120-day fit guarantee on our hybrid bat models. Customers who are dissatisfied with the fit of their new TRUE Temper bat may request an exchange within 120 days of the original date of purchase. This guarantee expires 120 days from the date of purchase. This guarantee is limited to three (3) uses per receipt. It is within the sole discretion of True Temper to increase or decrease the amount of times a customer may use this guarantee.

Unused and unopened bats will be subject to our standard exchange and return policy. Issues related to defects in materials and workmanship should be handled via a limited warranty claim.

The originally purchased bat must be shipped back to TRUE Temper, and be received and inspected, before a replacement bat may be shipped out. TRUE Temper will cover the cost of ground shipping both ways. Expedited shipping options may be available at the consumer’s expense.

Returned bats must be in good condition and a valid receipt from an authorized TRUE Temper dealer must be provided to qualify. The 120-day guarantee applies to purchases made on truetempersports.com, TRUEfit Events, and authorized TRUE Temper Baseball dealers.

This offer does not apply to purchases from unauthorized TRUE Temper dealers. All fraudulent returns will be prosecuted to the fullest extent permitted by law.

 

SHIPPING ON RETURNS AND EXCHANGES IS ALWAYS FREE!

EXCHANGES (TRUE Temper Baseball Website and TRUEfits only)

We are able to exchange products for alternate sizes/colors of the exact product purchased within 30 days of the purchase date.  We are not able to exchange a product for a different model. Once the product arrives at our warehouse, we will examine and ensure the product is new, unused, unwashed and in the original packaging (this includes the box, plastic poly bag, and tags). For all exchanges, we will ship a replacement product within 5-7 business days from the time we receive the original product in our warehouse. You will not be charged any additional shipping or restocking fees.

RETURNS (TRUE Temper Baseball Website and TRUEfits only)

For all returns, a refund will be credited back to the original method of payment used to place the order, within 5-7 business days from the time we receive the product in our warehouse. All products must be returned within 30 days of the purchase date and be new, unused, and in the original packaging (this includes the box, plastic poly bag, and tags) that it was shipped in. Returns submitted after 30 days will be refunded in form of a store credit. NO EXCEPTIONS.

  1. THE PRODUCT WAS PURCHASED FROM AN AUTHORIZED TRUE SPORTS DEALER.
  2. THE ORIGINAL PURCHASER RETAINS A PROOF OF PURCHASE (RECEIPT) FROM THE ORIGINAL TRANSACTION.
  3. THE WARRANTY CLAIM IS MADE WITHIN THE APPLICABLE WARRANTY PERIOD.

CUSTOM SKATE GUARANTEE:
DUE TO THE 100% CUSTOM NATURE OF OUR PRO CUSTOM SKATE, SCANNED FOR YOUR INDIVIDUAL FOOT AND PROUDLY HANDCRAFTED IN CANADA, TRUE HOCKEY DOES NOT OFFER A MONEY BACK GUARANTEE. IF THE CUSTOMER IS NOT SATISFIED WITH THE FIRST PAIR, WE WILL ATTEMPT TO ADJUST THE SKATES USING A SERIES OF FITTING TECHNIQUES. SHOULD THE CUSTOMER REMAIN UNSATISFIED AND BOTH PARTIES HAVE DETERMINED THAT ALL MEANS HAVE BEEN TAKEN TO ADJUST THE CUSTOM FIT, TRUE HOCKEY WILL MAKE A SECOND PAIR AT NO CHARGE TO THE CUSTOMER. THE CUSTOMER IN THIS CASE WILL BE RESPONSIBLE FOR SHIPPING THE SKATES BACK TO TRUE HOCKEY AND ALL RELATED CHARGES WILL BE THE RESPONSIBILITY OF THE CUSTOMER. TRUE HOCKEY WILL COVER ALL COSTS ASSOCIATED WITH BUILDING THE NEW PAIR AND SHIPPING THEM BACK TO THE CUSTOMER.

6 MONTH MANUFACTURER’S WARRANTY:
IF WITHIN THE FIRST 6 MONTHS OF USE YOUR BOOTS SUSTAIN ANY BREAKDOWN OR DAMAGE NOT CAUSED BY REGULAR GAME USE, TRUE HOCKEY WILL FIX THE DAMAGE. THE CUSTOMER IS RESPONSIBLE FOR RETURN SHIPPING CHARGES.

1 YEAR MANUFACTURER’S WARRANTY ON BLADES & HOLDERS:
IF WITHIN THE FIRST 12 MONTHS OF USE YOUR TRUE HOLDER OR STEEL BLADE SUSTAIN BREAKAGE NOT CAUSED BY REGULAR GAME USE, TRUE HOCKEY WILL REPLACE THEM AT NO CHARGE. THE CUSTOMER IS RESPONSIBLE FOR RETURN SHIPPING CHARGES.

OUTSIDE WARRANTY REPAIRS:
AT TRUE HOCKEY WE STAND BEHIND OUR PRODUCT AND THEREFORE WE WILL FIX ANY ISSUE THAT ARISES WITH YOUR BOOTS OUTSIDE OF THE WARRANTY PERIOD. THE CUSTOMER WILL BE RESPONSIBLE FOR THE RETURN SHIPPING IN BOTH DIRECTIONS PLUS A FEE FOR THE REPAIR. ANY SKATES/BOOTS THAT ARE SHIPPED TO TRUE HOCKEY NEED TO BE CLEARLY MARKED “WARRANTY REPAIR” ON THE SHIPPING PACKAGE OR CUSTOMS CLEARING CHARGES MAY APPLY.  ANY CUSTOMS CLEARING CHARGES WILL BE THE RESPONSIBILITY OF THE CUSTOMER.

TRUE SPORTS WILL PROVIDE A ONE-TIME REPAIR OR REPLACEMENT WITHIN 90 DAYS FROM THE ORIGINAL DATE OF PURCHASE (“WARRANTY PERIOD”) FOR STOCK SKATE BOOT DAMAGE THAT OCCURS DURING NORMAL PLAYING CONDITIONS.
TRUE SPORTS WILL PROVIDE A ONE-TIME REPAIR OR REPLACEMENT WITHIN 12 MONTHS FROM THE ORIGINAL DATE OF PURCHASE (“WARRANTY PERIOD”) FOR STOCK SKATE HOLDER, RUNNER, CHASSIS DAMAGE THAT OCCURS DURING NORMAL PLAYING CONDITIONS.

THESE WARRANTIES WILL BE HONORED PROVIDED THE FOLLOWING CONDITIONS ARE MET:

  1. THE PRODUCT WAS PURCHASED FROM AN AUTHORIZED TRUE SPORTS DEALER.

BULK DISCOUNTED PURCHASES UNDER THE TEAM SALES PROGRAM AND SALES TO SENIOR COMPETITIVE, PROFESSIONAL OR SEMI PROFESSIONAL, JUNIOR AND COLLEGE/UNIVERSITY LEVELS ARE NOT COVERED UNDER OUR 30 DAY ONE TIME REPLACEMENT PROGRAM BUT MAY BE COVERED UNDER SOME CIRCUMSTANCES SUCH AS CONFIRMED MANUFACTURING DEFECTS.

TO MAKE A WARRANTY CLAIM, YOU MUST CONTACT TRUE SPORTS DIRECTLY, DO NOT CONTACT YOUR TRUE SPORTS RETAILER.

PLEASE FOLLOW THE STEPS TO MAKE A WARRANTY CLAIM:

  1. COMPLETE THE WARRANTY CLAIM FORM FOR FOR HOCKEY PRODUCTS
  2. TRUE SPORTS WILL INSPECT IMAGES OF THE DAMAGED PRODUCT TO DETERMINE IF THE DAMAGE WAS CAUSED BY NORMAL USE OR IF THERE IS EVIDENCE OF MISUSE, TAMPERING, ABUSE, OR DECEPTION. DO NOT PHYSICALLY SHIP ANY DAMAGED PRODUCT TO TRUE SPORTS UNLESS YOU HAVE BEEN ASKED TO DO SO.
  3. IF YOUR CLAIM MEETS OUR POLICY REQUIREMENTS, TRUE SPORTS WILL SEND YOU A RETURN AUTHORIZATION NUMBER (RA) WITHIN 5 BUSINESS DAYS ALONG WITH INSTRUCTIONS ON WHAT TO DO WITH THE DAMAGED PRODUCT.
  4. IF TRUE SPORTS DETERMINES THAT YOUR PRODUCT IS COVERED BY THE WARRANTY, THEN TRUE WILL AT ITS SOLE OPTION AND IN ITS SOLE DISCRETION (1) REPLACE YOUR PRODUCT WITH THE SAME MODEL OR (2) REPLACE YOUR PRODUCT WITH A COMPARABLE MODEL SHOULD YOUR PRODUCT BE DISCONTINUED OR OTHERWISE UNAVAILABLE, OR (3) REPAIR YOUR PRODUCT, OR (4) PROVIDE YOU WITH A VOUCHER TO BE USED TOWARD THE PURCHASE OF OTHER TRUE HOCKEY PRODUCTS.

TRUE SPORTS WILL PAY NORMAL GROUND FREIGHT CHARGES TO SEND BACK THE REPLACEMENT PRODUCTS.

NOTE – TRUE SPORTS RESERVES THE RIGHT TO REFUSE WARRANTY SERVICE TO ANY PERSON WHO, IN TRUE’S SOLE DISCRETION, ABUSES ITS PRODUCTS OR WARRANTY POLICY.

BY USING THE PRODUCT, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS LIMITED WARRANTY. BEFORE USING THE PRODUCT, PLEASE READ THIS LIMITED WARRANTY CAREFULLY. IF YOU DO NOT AGREE TO THE TERMS OF THIS LIMITED WARRANTY, DO NOT USE THE PRODUCT. RETURN THE PRODUCT TO THE DEALER OF PURCHASE. SEE THE DEALER’S RETURN POLICY FOR DETAILS AND/OR ADDITIONAL RETURN REQUIREMENTS.

Lacrosse Head Limited Warranty

True Temper Lacrosse will provide a one-time repair or replacement within 6 months from the original date of purchase (“Warranty Period”) for lacrosse head breakage that occurs during normal playing conditions provided the following conditions are met:

  1. The product was purchased from an authorizedTrue Temper Lacrosse Dealer.

  2. The original purchaser retains a proof of purchase (receipt) from the original transaction.

  3. The warranty claim is made within the applicable warranty period.

  4. The head was not gratuitously abused, altered (i.e. pinched, baked), defaced or otherwise negligently damaged, including prolonged exposure to inclement weather.

  5. The return was handled properly per theTrue Temper Lacrosse return process as outlined below:

*Head Limited Warranty Exclusions:

The following products are NOT covered by the limited head warranty:

– The lacrosse pocket, including all strings

– Cosmetic issues such as chips, dings, & deformation of head shape from the result of normal game play.  

– Promotional or demo products (ex. free product / camp giveaway / demos, etc.)

– Used / pre-owned products  

NOTE: A replacement product does not start a new Warranty Period.

 

Lacrosse Handle Limited Warranty

True Temper Lacrosse will provide a one-time repair or replacement within 6 months from the original date of purchase (“Warranty Period”) for lacrosse handle breakage that occurs during normal playing conditions provided the following conditions are met:

  1. The product was purchased from an authorized True Temper Lacrosse Dealer.

  2. The original purchaser retains a proof of purchase (receipt) from the original transaction.

  3. The warranty claim is made within the applicable warranty period.

  4. The handle was not gratuitously abused, altered (i.e. intentionally bent), defaced or otherwise negligently damaged, including prolonged exposure to inclement weather.

  5. The return was handled properly per theTrue Temper Lacrosse return process as outlined below:

*Handle Limited Warranty Exclusions:

– All Alloy (metal handles)

– Cosmetic issues such as chips, dings, scratches, grip wear are not covered by the limited handle warranty policy.

– Promotional or demo products (ex. free product / camp giveaway / demos, etc.)

– Used / pre-owned products  

NOTE: A replacement product does not start a new Warranty Period.

 

Lacrosse Protective, Bags, Apparel Limited Warranty

True Temper Lacrosse will provide a one-time repair or replacement within 30 days from the original date of purchase (“Warranty Period”) for lacrosse gloves, protective equipment (shoulder pad, arm pads, etc.), bags, apparel against non-conformance fromTrue Temper Lacrosse workmanship specifications that occurs during normal use, provided the following conditions are met:

  1. The product was purchased from an authorizedTrue Temper Lacrosse Dealer.

  2. The original purchaser retains a proof of purchase (receipt) from the original transaction.

  3. The warranty claim is made within the applicable warranty period.

  4. The product was not gratuitously abused (ex. ripped, cut, torn), misused, damaged by neglect, including prolonged exposure to inclement weather.

  5. The product was not modified or altered, including any repair done outside of True Temper Lacrosse customer service.

  6. Any stated care instructions listed on the product or packaging were followed

  7. The return was handled properly per theTrue Temper Lacrosse return process as outlined below:

– Promotional or demo products (ex. free product / camp giveaway, demos, etc.)

– Used / pre-owned products

True Temper Lacrosse – Product Return Process / Making a Warranty Claim

To make a warranty claim, you must contact TRUE Sports directly, do not contact your TRUE Sports retailer. 

Please follow the steps to make a warranty claim:

  1. Complete the Warranty Claim Form for Lacrosse Products

  2. True Temper Lacrosse will inspect images of the damaged product to determine if the damage was caused by normal use or if there is evidence of misuse, tampering, abuse, or deception.

  3. If your claim meets our policy requirements, True Temper Lacrosse will send you a return authorization number (RA) within 5 business days along with instructions on what to do with the damaged product.

  4. If True Temper Lacrosse determines that your product is covered by the warranty, thenTrue Temper Lacrosse will at its sole option and in its sole discretion (1) replace your product with the same model or (2) replace your product with a comparable model should your product be discontinued or otherwise unavailable, or (3) repair your product.

True Temper Lacrosse will pay normal ground freight charges to send back the replacement products.

Note – True Temper Lacrosse reserves the right to refuse warranty service to any person who, in True Temper Lacrosse's sole discretion, abuses its products or warranty policy.
